TEMPLE Dive Center
Preamble
The company JAVA PAMA TEMPLE (Commercial name Temple diving) is a diving centre offering all activities related to scuba diving, and various tourism and leisure activities. Its registered office is in Jalan Ped, Buyuk, Sekola Desa, Nusa Penida, Bali, Indonesia.
The privileged place of the activity and the reception of the customers is located in Nusa Penida.
For the purposes of these general terms and conditions of sale and service, it is understood that Java Pama Temple and the persons ordering one or more Products or Services will collectively be referred to for Java Pama Temple: “Temple” or “Seller”, and for persons who have placed an order, the “Buyer” or the “Customer”.
Participant’s agreement
“I acknowledge that my activity managed by Temple is conditioned by the guarantee that I am physically fit to practice scuba diving / snorkeling, that I understand the risks associated with scuba diving, travel on board the diving boat. I release Temple, its staff or other divers from any damage, injury or death in connection with scuba diving or snorkeling activities. I accept the Temple general terms and conditions of sale described below.
Article 1. Object
By this document, Temple defines the general terms and conditions of sale that are applicable to all business relationships between the Seller and Customers (individuals and groups).
These general terms and conditions of sale also govern all forms of promotion, unless otherwise provided for in these commercial transactions and specified by the Seller in connection with these transactions.
A version of the general terms and conditions of sale is available on the Temple website (www.templediving.com) as well as on the www.doku.com website at the time the Client requests a reservation for diving services. Any request for a reservation with Temple implies acceptance of these general terms and conditions of sale.
Article 2. Products – Services
2.1 Availability
Offers for Products and Services are described on the website as well as on information tools posted in the centre.
These offers are valid, within the limits of available stocks or opening dates, as long as they are visible on the Website or on the information panels in the centre in Nusa Penida.
The photographs, images or other reproductions presented on the Website to illustrate the Products or Services offered are not contractual. The Purchaser is invited to consult the description of each Product and Service to find out about its availability, characteristics and, where applicable, any other information relating to its conditions of use or use.
2.2 Exploration dives
The price of the exploration dive includes:
Transport on site by boat, if necessary
The supply of equipment: wetsuit, fins, mask, vest, regulator, octopus
The supply of the belt and ballast
The supply of the inflated bottle
The rental of the instructor’s services for dives at the “supervised” rate or requiring supervision (first dive, exploration, training…)
The price of the exploration dive does not include:
The dive computer, the parachute
If applicable, supplements related to the characteristics of the dive(s), and without being exhaustive: deep diving, deep diving, night diving, etc….
A preferential rate is applied to professionals and customers in possession of their complete equipment (excluding bottles).
2.3 Diving packages
Temple offers discounted rates for exploration dives, in the form of “Diving Packages”. These formulas are valid for a period of 12 months from the date of purchase.
Diving packages are personal and can only be used by one diver.
Beyond the validity date, the dives of the Unconsumed Dive Package can be re-credited when purchasing a new package, otherwise they are lost by the client.
2.4 Baptisms and snorkeling
The price of the baptisms includes:
Transport on site by boat, if necessary
The supply of equipment: wetsuit, fins, mask, vest, regulator, octopus
The supply of the belt and ballast
The supply of the inflated bottle
Rental of instructor services
The price of the web tours includes:
Transport on site by boat, if necessary
The supply of fins, mask and snorkel
Rental of the instructor’s services for supervised hikes
2.5 Rental of equipment
TEMPLE makes the following equipment available to Customers: – Combinations – Fins, masks, snorkels – Vests – Regulators with octopus – Computers – Parachutes – Lamps
This equipment is available for rental at the rates posted at the dive centre.
2.6 Customer’s Obligations
The Client must personally ensure that he/she is in possession of all the qualifications and supporting documents required for the activity he/she wishes to perform and produce the originals at TEMPLE before the start of these activities.
2.7 Validation of a diving level or first aid training
TEMPLE reserves the right not to deliver a diving or first aid level if the Client has not reached the minimum skills related to the level expected by the training. This case cannot give rise to any refund.
Article 3. Prices
All prices shown are in Indonesian rupees. The prices valid are those in force at the time of the reservation made by the Customer.
Article 4. Reservation
The Client’s reservation will only be definitively registered upon receipt of a deposit of 50% of the total amount, with a minimum payment of IDR 350,000 or the full amount if the total price is less than IDR 350,000. The balance will be paid on site before the diving and accommodation services.
As from the registration of the reservation, an e-mail confirmation from the Seller will be sent to the Customer, specifying the dates of the services.
For the follow-up of reservations, TEMPLE sends by email a confirmation of receipt of the reservation and receipt of the deposit.
The payment of the deposit and other fees or taxes is made in Indonesian rupees and for all amounts corresponding to the orders.
The payment of the deposit can be made:
On site, in the centre of Nusa Penida, in cash or by credit card (Visa-Master Card)
Online on our secure partner site Doku.
Booking by a agent (travel agency, tour operator…)
Temple establishes partnership contracts with referenced agents. No services will be provided by Temple if the client presents himself by having paid a payment to a service provider that would not be referenced by Temple.
Any reservation made directly by the customer, even if he claims to be recommended by an agent, will not be subject to a retroactive commission for an agent not referenced.
Article 5. Payment of benefits
Benefits are paid in full before the start of operations
Article 6. Cancellation conditions
6.1 By the Client
The customer must inform TEMPLE in writing (email or whatsapp) of his cancellation.
-Cancellation more than 72 hours before the service: full refund of the deposit, deduction of the administrative costs of 175 000 IDR and any other possible bank charges borne by TEMPLE.
Cash payments can be refunded in cash and credit card payments will be refunded within a maximum of 15 days after the customer’s cancellation.
Cancellation less than 72 hours before the service: TEMPLE will refund 50% of the amount received for the reservation
Cancellation less than 24 hours before the service: TEMPLE will keep all the sums received for the reservation.
In the event of a cancellation reported more than 24 hours before the start of the service, TEMPLE may, if possible, propose another date to the Client so that he can carry out the reserved service. In the event that it is impossible for the Client to change the date, all sums already paid by the Client will remain the property of TEMPLE.
Any activity started will not give rise to any refund, if the cancellation is due to the Client (personal convenience, ear problems, stress or any other reason whatsoever). In the case of a training, stay or internship reserved for a defined period: TEMPLE shall not be liable if, for personal reasons, the Client has to interrupt the training, stay or internship or if the Client does not appear at the place or on the scheduled date. In particular, the sums already paid would remain the property of TEMPLE and all costs incurred would remain the responsibility of the Client.
As this is a stay for a group of divers (club trip, works council, summer camp, etc…), the price of the dives being negotiated on the basis of a global package, no refund can be made if one or more dives have to be cancelled for personal reasons or due to unfavourable weather conditions.
6.2 By TEMPLE
A dive service may be cancelled by TEMPLE for meteorological or technical reasons.
In the event of cancellation for meteorological reasons, TEMPLE may propose postponing the service to another more favourable date, within the limits of available places. In the event that the Client is unable to postpone the services (duration of the stay too short), the sums already paid to TEMPLE will remain definitively acquired by the Client without any refund being due.
As this is a stay for a group of divers (club trip, works council, summer camp, etc…), the price of the dives being negotiated on the basis of a global package, no refund can be made if one or more dives have to be cancelled for unfavourable weather conditions and no postponement is possible.
In the event of cancellation for technical reasons, TEMPLE may propose postponing the service to another more favourable date, within the limits of available places. In the event that the Client is unable to postpone the services (duration of the stay too short), TEMPLE undertakes to reimburse the amount of the services not provided.
In all these cases of unforeseeable circumstances or events, the additional costs resulting from the partial postponement, total postponement or extension of the stay remain the responsibility of the Client.
Article 7. Responsibilities
The Client is automatically covered for civil liability during the sessions and dives organised by TEMPLE due to the insurance taken out by the company. The Client is advised to take out additional insurance (bodily injury and material damage) to carry out the activity of scuba diving as well as cancellation insurance with an authorised body.
Article 8. Security and personal belongings
Temple Dive Center is in no way responsible for personal items deposited or entrusted to the dive center. The dive centre shall not be responsible for any theft or loss of personal property in the dive centre or during the diving service.
Article 9. Equipment of the diving centre
The Client agrees to pay Temple compensation equal to the full current market value for any damage or loss of Temple-owned property and equipment resulting from abuse or negligence on its part (except damage due to reasonable and visible wear and tear).
Exemples of compensations : Weight belt buckle stainless 300 000 idr ; Weight (unit) 60 000 idr ; Mask Open Water 500 000 idr ; Snorkel 150 000 idr; Fins (1 or both) 1 200 000 idr ; Dive computer Suunto 3 500 000 idr. ; Compas 500 000 idr.
Article 10. Preservation and archiving of transactions
TEMPLE reserves the right to choose the necessary media to archive invoices and other documents relating to any transaction in order to maintain reliable, accurate and durable traceability.
Article 11. Website Privacy Policy
This policy applies to www.templediving.com.

the manner in which personal information is collected and processed. Personal information includes information that can identify the customer;
the rights to this information;
who is responsible for processing this information;
to whom this information is transmitted;

11.3 Log and Control Files
TEMPLE collects certain information through log files and cookies. These files are used to process statistics and traffic information, facilitate navigation and improve service. The customer may object to the recording of these cookies by configuring his browser software.

The personal information collected by the site is not transmitted to any third party and is only processed by TEMPLE.
